City of ORONO <br />RESOLUTION Of THE CITY COUNCIL <br />NO. 1581 <br />4. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the owner and other interested <br />persons, and the effect of the proposed variances on the health, <br />safety and welfare of the community. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district: that granting the variances <br />would not adversely effect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the owner, but is necessary to <br />alleviate a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the owner; and would be <br />in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby grants <br />variances to Municipal Zoning Section 34.842 to permit the <br />construction of a single family residence on a property that consif-ts <br />of 1.5 acres in area instead of the required 2 acres to be located 30 <br />feet from the front lot line instead of the required 50 feet, subject to <br />the following conditions: <br />1. Prior to issuance of a building permit, the applicant must <br />submit septic design and final site grading plan. <br />2. Applicant must provide City with temporary erosion control <br />plan to cover entire construction period this would include all <br />preliminary grading. <br />3. No other variances are granted or permitted for this <br />structure. <br />4. Authorities granted by this variance run with the property <br />not with the oliaer, but are permissive only and must be exercised <br />by appl icatic.n for a building permit within one year of the date of <br />Council approval, or this variance will expire on that date <br />(November 14, 1984). <br />
