Hayssen" and <br />"Helen F. Hayssen." <br />Copies of these documents are enclosed for your information. <br />Based only upon our examination of s '3 Condition of the <br />Register as to Certificate of Title No. 704685 and said <br />Certificate, and not upon the files and records in said County <br />and State, it is our opinion that title in fee simple on <br />September 24, 1990 was vested in: <br />Charles N. Hayssen and Helen F. Hayssen as joint <br />tenants <br />subject to the following: <br />1. Restrictions dated May 29, 1958, filed for <br />registration on June 16, 1958 as Document <br />No. 560527 creating restricitons and covenancs as <br />to Tract B, R.L.S. 748. <br />2. Quit Claim Deed dated November 14, 1960, filed <br />for registration on December 1, 1960 and on <br />February 21, 1961 as Document No. 643950 in favor <br />of Edson Wtite Spencer and Harriet Stuart <br />Spencer, as joint tenants, granting an easement <br />for private driveway purposes over and across <br />Tract F, R.L.S. No. 748 and other property, which <br />easement shall be appurtenant to Tracts A, B and <br />C, R.L.S. 748. <br />Note: We have been informed that the validity of <br />this easement has been disputed. <br />3. Declaration dated June 17, 1987, filed for <br />registration on July 30, 1987 as Document <br />No. 1857047, creating covenants, condi,',ns, <br />restrictions and reservations for a pe;- 3 of 50 <br />years from June 17, 1987. <br />4. Mortgage in favor of FBS Mortgage Corporation, <br />Minneapolis, Minnesota dated December 9, 1988, <br />filed for registration on December 19, 1988 as <br />Document No. 1982579, in the original principal <br />amount of $340,000.00. <br />5.
