Mr. McDowell owns part <br />of Tract A, R.L.S. 748 and all of Tract D, R.L.S. 540. Charles and <br />Helen Hayssen own Tract B, R.L.S. 748 and part of Tract A, R.L.S <br />748. As you know, Mr. McDowell and the Hayssens have agreed t— <br />replat their property to effect a lot lint- rearrangement. I am <br />enclosing for your information a copy of the proposed plat. I am <br />also enclosing a copy of a Quit Claim Deed dated Novembe- 14, 1960, <br />creating a driveway easement for the benefit of Tracts A, B and C, <br />R.L.S. 74H. <br />Mr. McDowell pur chasc -cts A, B and C, R.L.S. 748 frcr.I <br />Edson and Harriet Spender 1987. In connection with that <br />purchase, Minnesota Title issued Mr. McDowell a title insurance <br />policy expressly insuring the driveway easemen` as a 11id <br />appurtenant easement benefiting Tracts A, B and C, K.L.S. 748. rir. <br />McDowell subsequently sold Tract B and part of "act A to the <br />Hayss•:ns and Tract C to James and Marie Alt. nesota Title <br />examir 1 title on both occasions and issued policies to the <br />Haysse.ts and the Al#s insuring the validity of the driveway <br />easement. <br />As you know, Robert White has challenged the validity of the <br />easement. We ha a referred the matter to Minnesota Title. If it <br />is determined.that the original grant was ineffective, Minnesota <br />Title will have an oblig•tion to taxe •,thatever steps are r.ezes ,ary <br />to secut- a valid driveway easement. <br />
