City of Orono <br />September 17, 1990 <br />Page 2 <br />"John D. McDowell," "Mrs. John D. McDowell," and "Laurie <br />D. McDowell." <br />Copies of these documents are enclosed for your information. <br />Based only upon our examination of said Condition of <br />Certificate of Title and said Certificate, and not upon the files <br />and records in said County and State, it is our opinion that title <br />in fee simple on August 28, 1990 was vested in: <br />John D. McDowell, <br />subject to the following: <br />1. Quit Claim Deed dated November 14, 1960, filed for <br />registration on December 1, 1960 as Document No. 643950 <br />in fa:_., of Edson White Spencer and harriet Stuart <br />Spencer, as joint tenan::s, granting an easement for <br />private driveway purposes over and across Tract F, R.L.S. <br />No. 748 and other property, which easement shall be <br />appurtenznt to Tracts A, B and C, R.L.S. 748. <br />Note: The validity of this easement is the subject of <br />the dispute described in our letter dated November 9, <br />1989 to Michael Gaffron, a copy of which is attached for <br />information purposes only. <br />2. Declaration dated June 17, 1987, filed for registration <br />on July 30, 1987 as Document No. 1857047, creating <br />covenants, conditions, restrictions and reservations for <br />a period of 50 years from June 17, 1987. <br />3. Declaration dated June 17, 1987, filed for registration <br />on July 30, 1987 as Document No. 1857048, creating a <br />restrictive covenant. <br />4. Mortgage in favor of Ridgedale State Bank, Minnetonka, <br />Minnesota dated August 10, 1989, fled for registration <br />October 31, 1989 as Document No. 2049931, in the original <br />principal amount of $200,000.00. <br />5. Real estate taxes and installments of speci .1 assessments <br />payable in the year 1990, if not yet paid. <br />Note: Second half taxes are not due until October 15, <br />1990. <br />
