MINUTES OF THE PLANNING COMMISSION MEETING JANUARY 16, 1990 <br />ZONING FILE 31473-KELLY CONTINUED <br />regulations. <br />Mr. Bear said that the house has four 8' sliding glass doors <br />in that location and he could not have them opening onto nothing. <br />Mr. Bear• added that the applicants have talked with the <br />neighboring property owners and they approve of the deck. <br />Mr. Klien indicated that the site lines were cut down <br />because the old deck had more of a "boxy" appearance and did not <br />tier down the hill. Mr. Klien said that the railing on the old <br />deck was thick wood. <br />Kelley observed that the new deck does not have railings, <br />which he added are needed, and it is difficult to tell what the <br />site lines will be once they are installed. <br />Mr. Klien informed the Planning Commission that he is <br />proposing tubular railings rather than wood railings. <br />There were no comments from the public regarding this matter <br />and the public hearing was closed. <br />Kelley said, "We have been pretty consistent on decks, <br />hardcover• and hardships in Orono. From my point of view, you can <br />replace what was there and stay within the ordinance. The <br />increase in the 0-75' setback zone, even if it's minimal, is <br />objectionable in my opinion, as I have been a strong supporter_ of <br />maintaining the lakeshore protective area. In regard to the 75- <br />250' zone, if you can delete other parts of the hardcover on the <br />property within that zone to bring hardcover back to 57.2%, I <br />don't have any problem with that. As to the average lakeshore <br />setback, I think we have to stay within what we were before. We <br />have, however, in the past dealt with grade level decks a little <br />differently. However, this does not classify a6 a grade level. <br />deck." Kelley advised the applicants that the deck would have to <br />be brought back to the site lines that existed with the previous <br />deck. <br />It was moved by Kelley, seconded by Moos, to recommend <br />denial of the average lakeshore setback variance of 19' to 20', <br />the variances to increase hardcover in the 0-75' and 75-250' <br />setback areas, as well as the sideyard setback variance. Kelley <br />said t:..+t he would approve what pre-existed Hanson asked what <br />co,Ald be done in the interim period to make the existing <br />situation safe.
