Prior to your
leaving town, we had briefly discussed the potential City
concerns and requirements for such a proposal.
You had expressed a concern that the City might still
require granting a private road outlot as part of a mere lot line
rearrangement. Although I had indicated that was not as likely
with a lot line rearrangement, Jeanne and I have discussed the
issues at some length, and in light of the access issues and
Planning Commission's concerns regarding access and private roads
in the City, it would not be out of the question for them to
require road outlot dedication. It would also not be out of the
question for them to hold up even a lot line rearrangement
pending resolution of the access issues.
In order t
requirements for
the subdivision
metes and bounds
not specifically
be a plat, howev
concerns which have evolved along with
roEerties don't abut a dedicated public
technically variances to the zoning code
this a "flexible zoning application" which
As I
advised t
revising y
o
mentioned before you
o discuss these issues
ur application.
o give Ms. Howe clear di
a lot line rearrangement, Je
code regarding the need for
division. it is our opinion
address whether this lot line
er we feel that given the na
rection as to the
nne and I reviewed
a plat vs. a simple
that the code does
rearrangement must
ture of the access
a
the fact that these
or private roadway,
are required, making
requires a plat.
left town, you would be well
with Jeanne Mabusth prior to
Bt ILDIV; • ZO\LrG - V3-7351 • ADM11I57RATH)1 k F7VA(7 ,'t_-1q1 • Pt BIA %4ORKS - 473.73"
ASS<tiSIVG F4% - 4734514
