O. Box 66 <br />crystal Bay, MN 55323 <br />Dea- Mr. Gaffron: <br />Our firm represents John D. McDowell. Mr. McDowell owns part <br />of Tract A, R.L.S. 748 and all of Tract D, R.L.S. 540. Charles and <br />Helen Hayssen own Tract B, R.L.S. 748 and part of Tract A, R.L.S. <br />As you know, Mr. McDowell and the Hayssens have agreed to <br />replat their property to effect a lot line rearrangement. I am <br />enclosing for your information a copy of the proposed plat. I am <br />also enclosing a copy of a Quit Claim Deed dated November 14, 1960, <br />creating a driveway easement for the benefit of Tracts A, B and C, <br />R.L.S. 748. <br />Mr. McDowell purchased Tracts A, B and C, R.L.S. 748 from <br />Edson and Harriet Spencer in 1987. In connection with that <br />purchase, Minnesota Title issued Mr. McDowell a title insurance <br />policy expressly insuring the driveway easemerz as a valid <br />appurtenant easement benefiting Tracts A, B and C, R.L.S. 748. Mr. <br />McDowell subsequently sold Tract L, and part of Tract A to the <br />Hayssens and Tract C to James and Marie Alt. Minnesota Title <br />examined title on both occasions and issued policies to the <br />Hayssens and the Alts insuring the validity of the dri-eway <br />easement. <br />As you know, Robert White has challenged the validity of the <br />easement. We have referred the matter to Minnesota Title. If it <br />is determined that the original grant was ileffective, Minnesota <br />Title will have an obligation to take whatek,,ar steps are necessAry <br />to secure a valid driveway easement. <br />
