the Easement Area and constructing a driveway thereon in accordance with all applicable laws and regulations, as well as for all maintenance and repair of the Easement Area and all improvements thereon which may hereafter be required by the City of Orono or by any other political subdivision or government agency. 4. McDowell shall have the right, at his sole cost, to landscape the Easement Area, including the right to plant trees and other vegetation and to place rocks and other landscape materials within the Easement Area. McDowell shall be solely responsible for the maintenance thereof. Prior to any such landscaping, McDowell shall submit a landscape plan to VCI for approval, V ich approval shall not be unreasonably withheld or delayed. 5. If any use made of.the Easement Area shall increase the real estate taxes, special assessments or insurance premiums of any other party or make continuance of the driveway illegal, the party making such use shall be liable for such increased cost or for any costs and other consequences of such illegality. 6. The easement and covenants created hereby shall be covenants running with the land and shall inure to the benefit of and be binding upon the parties hereto and their respective heirs, successors and assigns. 7. Failure by either party to enforce any covenant herein shall in no event be deemed a waiver of the right to do so thereafter.
