� Y Y <br />THIS AGREEMENT is made on , 1990, by Robert P. <br />White and Avis N. White, husband and wife ("Whites"), VCI Capital, <br />Inc., a Minnesota corporation ("VCI"), and John D. McDowell. and <br />Laurie D. McDowell, husband and wife ("McDowells"). <br />WITNESSETH: <br />WHEREAS, Robert P. White is the fee owner of certain real <br />property in Hennepin County, Minnesota, legally described as <br />follows (and hereinafter referred to as "Parcel A"): <br />That part of the West 1/2 of the Northeast 1/4 of Section 6, <br />Township 117, Rands 23, described as follows: Beginning at a <br />point in the Ea: line of said West 1/2 of the Northeast 1/4 <br />distant 906.98 feet North of the Southeast corner of said West <br />1/2 of the Northeast 1/4; thence North along the East line of <br />said West 1/2 of the Northeast 1/4, a distance of 261 feet; <br />thence due West 513.35 feet; thence South 39 degrees - 17 <br />minutes 30 seconds West, 280.05 feet; thence South 11 <br />degrees - -,6 minutes - 30 seconds West, 345.23 feet; thence <br />Southerly 220 feet along a line which i- extended, would <br />intersect the Southwest corner of the East 1/2 of the West 1/2 <br />of the Northeast 1/4; thence Northeasterly to a point located <br />due South 233.4 feet from a point located North 85 degrees - <br />05 minutes West, 270 feet from the point of beginning; thence <br />due North 233.4 feet; thence South 85 degrees - 05 mir tes <br />East, 270 feet to the point of beginning. F <br />this description, the East line of West 1/2 of Northeas 4 <br />is assumed to bear due North and South. <br />WHEREAS, VCI is the fee owner of certain real property in <br />Hennepin County, Minnesota, legally described as follows (and <br />hereinafter referred to as "Parcel B"): <br />Lot 1, Block 1, North Arm Estates Third Addition; and <br />That part of the West 1/2 of the Northeast Quarter of Section <br />6, Township 117, Range 23, lying Southerly of the centerline <br />of "ounty Road No. 84, except that portion thereof platted as <br />Lot 1, Block 1, North Arm Estates Third Addition, and except <br />Parcel A described above. <br />WHEREAS, John D. McDowell is the fee owner of certain real <br />perty in Hennepin County, Minnesota, legally described as <br />follows (and hereinafter referred to as "Parcel C"): <br />Lot 3, Block 1, Bayside Ridge. <br />WHEREAS, the parties desire to establish certain rights to <br />and maintain vegetation on part of Parcel C for the benefit <br />
