Response: Without this variance, the owner would be denied the fundamental property right to <br />reasonably improve their property—a right freely enjoyed by all neighboring property owners. The <br />variance enables: <br />Replacement of an aging, non-conforming structure <br />Achievement of conforming impervious surface coverage <br />Creation of a safe, modern home meeting current building codes <br />Reasonable use of the property without environmental destruction <br />11. The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br />Response: The variance enhances rather than impairs community welfare: <br />Health: Preserved trees improve air quality and stormwater management <br />Safety: Increased setbacks from neighbors reduce fire spread risk <br />Comfort: Greater separation distances enhance privacy for all parties <br />Environmental: Reduced impervious surface and tree preservation protect water quality <br />Zoning Intent: Achieves superior outcomes compared to strict compliance <br />12. The granting of such variance will not merely serve as a convenience to the applicant <br />but is necessary to alleviate demonstrable difficulty. <br />Response: This variance addresses demonstrable physical difficulties, not mere inconvenience: <br />Without variance: Must remove 964" of trees (70% of total) <br />Without variance: Must construct multiple tiers of tall retaining walls <br />Without variance: Must dramatically alter the natural topography <br />Without variance: Must accept environmental degradation inconsistent with city goals <br />The variance is necessary to enable any reasonable development that preserves the property's natural <br />character and environmental benefits. <br />19
