The amount of the special assessment shall not exceed the amount of <br />special benefit. All properties shall be considered equally. No <br />property receiving a special benefit shall be excluded from being <br />assessed therefore, although such assessment may be deferred <br />according to policies set out below. <br />4. Asses3ment Procedures will follow the requirements of Minnesota <br />Statutes Chapter 429: <br />a) receipt of petition requesting improvements <br />b) ordering feasii,ility report <br />c) receipt of feasibility report and ordering hearing <br />d) public hearing to consider improvements <br />e) ordering plans and specifications <br />f) approving plans and requesting bids <br />g) receipt of bids and preliminary determination of costs <br />h) ordering assessment hearing <br />i) public hearing to consider assessments <br />j) adopting assessment roll <br />k) awarding bid afte- expiration of assessment appeal period <br />1) conducting require(! hearings end adoption of supplemental <br />assessments after completion of construction of <br />original assessment: costs exceed <br />Note that an alternate pr )ce cure may be followed if assessment appeal <br />risks are low and/or if ass,-;-sment appeal waivers are received prior to <br />award of contract: <br />a) receipt of petition requesting improvements <br />b) ordering feasibility report <br />c) receipt of feasibility report and ordering hearing <br />d) public hearing to consider improvements <br />e) ordering plans and specifications <br />) approving plans and requesting bids <br />g) receipt of bids and preliminary determination of costs <br />11) award of bid and construction <br />page 3 of l5 <br />
