City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION APPROVING THE PLAT OF <br />A LOT LINE REARRANGEMENT KNOWN AS <br />YALE SMILEY ADDITION <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />subdivision regulations for the orderly, econom:, and safe <br />development of land within the City; and <br />WHEREAS, the City Council has considered the application for <br />a subdivision plat. by William Yale Smiley, the subdivider; and <br />WHEREAS, the subdivision will adjust the shared lot line <br />between Lots 1 and 2 so that the existing residence on Lot 1 meets the <br />required setback of 10 feet; and <br />WHEREAS, the City Council has approved permanent variances <br />for Lot 2 approving a lot area of 26, 342.5 sf instead of the required <br />43,560 sf and a lot width of 100 feet instead of the required 140 feet <br />based on the following findings: <br />1. The area and lot width of Lot 2 are consistent with the <br />surrounding developed lots of the Pheasant Lawn <br />neighborhood. <br />2. Sewer and Water are available to Lot 2. <br />3. The lots have been taxed separately since pur�:hased by <br />the subdivider. <br />4. There is no available undeveloped land to combine <br />with Lot 2. <br />WHEREAS, the subdivision will provide adequate buildiig <br />envelopes so that each lot is of a size and configuration that will <br />allow its use as a single family residence without the need of any <br />variances. The City Council will approve no variances for future <br />construction for Lots 1 and 2. <br />WHEREAS, the subdivider has completed all requirements of <br />the platting regulations of the City, including: <br />1. Dedication on the plat of drainage and utility <br />easements. <br />2. Payment to the City of a park dedication fee in the amount <br />of $440.00 <br />
