MINUTES OF THE: REGULAR COUNCIL. ME:E:TING HELD ON AUGUST 27, 1984. PAGE 3 <br />#832 HARRIET HEHL Councilmember Grabek stated that the difference in <br />grade is only about one foot from the s-irvey submitted. <br />Grabek stated that the grade is raised near the lake <br />and the grade across from Hehl's property is even with <br />ttie road. Grabek stated that Mr. McGreevy seems <br />satisfied, who was once in opposition to the fence. <br />Mayor Butler stated that when an individual builds a <br />house, they are allowed to grade. Butler stated that <br />the elevation of the current yard is the same a_ the <br />street. Butler stated that grading is allowed to <br />control drainage on a property. Butler asked did the <br />staff do right or wrong. Butler stated that she felt <br />the staff was right in interpreting the fence <br />ordinance. <br />Councilmember Frahm stated that the grading was done <br />near the tennis court. Frahm stated that he couldn't <br />see any grading done that would have affected Mrs. <br />Hehl's view. Frahm stated that this type of fence <br />along major thoroughfares are all over Orono. <br />Councilmember Grabek stated that the fence was not put <br />UP to spite anyone. Grabek stated that the code <br />allows grading to be done. Grabek stated that the <br />City can't protect everyone's view of the lake when <br />they don't even live on the lake. <br />Don Streeter stated that staff stated at the Planning <br />Commission meeting that if the request to build a <br />fence as presented along with a grading plan, that <br />staff would not have approved the fence. <br />Zoning Administrator Mabusth stated that today she <br />wouldn't have approved the fence because of the <br />Council's position on fences. Mabusth stated that <br />the grading was reviewed with the building permit and <br />that staff approved the grading plan. Mabusth noted <br />that at the time the grading was reviewed, the fence <br />was not proposed. <br />Kathy Jukish of 3280 Bayside Road asked Council if they <br />could adopt a fence ordinance to prevent this type of <br />fence from being constructed in the future. Jukish <br />asked Counci 1 if they could adopt a moratorium on all <br />fences. <br />Mayor But ler stated that the fence ordinance needs a <br />lot of work and that it couldn't be accomplisher' <br />tonight, but staff could look into revising the <br />ordinance. Butler stated that the City has tried <br />before to redo the fence ordinance but has had no luck. <br />Butler suggested adopting a moratorium on <br />construction of all fences. <br />
