. 2 RESOLUTION # 31 aORDERING ACQUISITIOX OF PERMANENT AND CONSTRUCTION EASE- MENTS: IQR,.. CERTAIN - SANITARY ,SEWER . IMPROVEMENTS. WHEREAS, in 1862 and 19-63 in accordance with the Statutes of the State•of.Minnesota,the Village Council of Orono gave ' - notice of a public hearing,conducted a,public hearing, giving interested persons an opporttmity to be heard and ordered the construction of certain sanitary sewer zmprovements'designated as follows: 63 TS 1 - Trunk sewer from -on or near County Road 51 t, from County Road 84 to County Road 19. 63 TS 2 - Trunk sewer on or near County Road 19 from the terminus of 63 TS 1 to Togo Road -63 LS 1 - Lateral sewer service on or near County Road •19 from Togo Road to County Road 15. `i 63 LS 2 - Lateral sewer service on or near County Road 15 from County Road 19 to Dunwoody.Avenue. '63 TLS - Trunk line sewer service along the routes as designated in 63.4. 1 and 63 TS 2. 63 IS 1 - Interceptor sewer on County Road 84 from County'Road 51 to sewage treatment plant. ' For the purposes of this resolution the above sanitary sewer im- �:` provements will be hereinafter called the Trunk, Lateral and In- a teraeptor Sanitary Sewer Improvements of 1963. a _ g_ WHEREAS, the Village Council .by resolution -adopted May 13, .1963,approve.d the detailed plans and specifications prepared by.William T. Mills for.construction of certain sanitary sewer improvements designated as the Trunk,Lateral and Interceptor Sariitary.Sewer Improvements of 1963; and WHEREAS; these approved plans indicate that certain perma- nent utility.easements,tempory construction easements and road- way•easements must be acquired in order to complete,construct and op:erate,,the Trunk,Lateral and Interceptor Sanitary Sewer Improvements of 1963: and WHEREAS, at the direction of said William TMills and by authorization of the 'Village Council,the State Surveying Company, by C.Donald.Coulter,surveyor,prepared from said approved plans =and by.a survey of the premises described in said plans,descrip- tions :of easements that must be acquired in order to complete, construct and operate the Trunk,Lateral and Interceptor Sanitary Sewer Improvements of 1963; and WHEREAS, the_°said. de.'scr•iptions of said easements are attach- ed hereto.an:d -designated as Parcel Nos.2 through 51,inclusive; WHEREAS, the Village of Orono has .commenc`ed certain con- demnati,on proceedings in the District Court of Hennepin County,' e Minnesota, as Condemnation Case NO -330 for*the purpose of ac- quiring said easements;. -and WHEREAS; the easements sought in said proceedings are nec- essary.and incidental to the construction of the Trunk,.Lateral (Next page)
