Improvements of 1963; and <br />WHEREAS, these approved plans indicate that certain pe-r- <br />manent utility easements,temporary construction .easements and <br />roadway easements must be acquired in order to complete con- <br />struct and operate the Trunk,Lateral and Interceptor Sanitary <br />' <br />Sewer Improvements of 1963,accordingly the Village of Orono <br />has commenced certain condemnation proceedings in the District <br />.� <br />Court of Hennepin County,Minnesota,as Condemnation Case #330 <br />for t'he purpose of acquiring said easements,that the easements <br />sought in said proceedings are necessary and incidental to the <br />construction of the Trunk,Lateral and Interceptor Sanitary <br />Sewer Improvements of 1963; and that the easements sought in <br />said proceedings are those easements designated and set forth <br />in said approved plans; and <br />WHEREAS, the Village of Orono hds•previously enacted cer- <br />tain resolutions authorizing the acquisition of the easements <br />described above by purchase or condemnation, and that such re- <br />solutions need clarification for the purpose of indicating that <br />the easements sought;_in the above described condemnation pro- <br />.' <br />ceedings are the same easements that are :set forth in said ap-` <br />proved plans; <br />1T61 , THEREF0RE',BE IT RESOLVED by the Village Council of the <br />Village-of Oron.o,Minnesota,as,follows: <br />1. Those. permanent utility.easements,temporary constrution <br />easements and roadway easements required for the comple-r <br />tion and construction and operation of the Trunk,Lateral <br />and Interceptor Sanitary Sewer Improvements of 1963',as:,'' <br />such are set forth in the approved plans referred to <br />above and for the acquisition of which the condemnation °... <br />proceedings referred to above have been.commenced,shall <br />, hereby be acquired by purchase or condemnation'. <br />2. That the acquisition of said eaaementa by said condem-..'` <br />nation proceedings is necessary and incidental to <br />completion,construction and operation of the Trunk., <br />Lateral and Interceptor Sanitary Sewer Improvements of ., <br />1963, and that such acquisition is for public-use as <br />- <br />provided for and authorized by law. <br />Adopted by the Village Council at•a regular me-eting held - <br />- <br />October 14,1963. <br />.
