r <br />0% <br />10.8.2 In lieu of the issuance of a certificate of Substantial completion as <br />.-. to part of the Work, Owner may take over operation of a facility constituting <br />part of the Work whether or not it is substantially complete if such facility <br />is functionally and separately usable; provided that prior to any such take- <br />over, Owner and Contractor have agreed as to the division of responsibilities <br />between Owner and Contractor for security, operation, safety, maintenance, <br />correction period, heat, utilities and insurance with respect of such facility. <br />M 10.8.3 No occupancy of part of the Work or taking over of operations of a fa- <br />cility will be accomplished prior to compliance with the requirements of Sec- <br />tion 8.1 in respect of property insurance. <br />10.9 FINAL INSPECTION <br />Upon written notice from Contractor that the Work is complete, Engineer will <br />make a final inspection with Owner and Contractor and will notify Contractor <br />in writing of all particulars in which this inspection reveals that the Work <br />is incomplete or defective. Contractor shall immediately take such measures <br />as are necessary to remedy such deficiencies. <br />10.10 FINAL APPLICATION FOR PAYMENT <br />n <br />After Contractor has completed all such corrections to the satisfaction of En- <br />gineer and delivered all maintenance and operating instructions, schedules, <br />guarantees, bonds, certificates of inspection, marked -up record documents and <br />other documents -- all as required by the Contract Documents, and after Engi- <br />neer has indicated that the Work is acceptable (subject to the provisions of <br />Section 10.12), Contractor may make application for final payment following <br />the procedure for progress payments. The final Application 'or Payment shall <br />be accompanied by all documentation called for in the Contract Documents and <br />such other data and schedules as Engineer may reasonably require, together <br />with complete and legally effecti•.e releases or waivers (satisfactory to Own- <br />er) of all Liens arising out of or filed in connection with the Work. In lieu <br />�. thereof and as approved by Owner, Contractor may furnish receipts or releases <br />in full; an affidavit of Contractor that the releases aad receipts include all <br />labor, services, material and equipment for which a Lien could be filed, and <br />that all payrolls, material and equipment bills, and other indebtedness con- <br />nected with the Work for which Owner or his property might in any way be re- <br />sponsible, have been paid or otherwise satisfied; and consent of the Surety, <br />if any, to final payment. If any Subeuntractor, manufacturer, fabricator, <br />supplier or distributor fails to furnish a release or receipt in full ;on - <br />tractor may furnish a Bond or other collateral satisfactory to Owner t indem- <br />nify Owner agains`. any Lien. <br />10.11 FINAL PAYMENT AND ACCEPTANCE <br />ri <br />�+ If, on the basis of Engineer's observation of the Work during construction and <br />final inspectior, and Engineer's review of the final Application for Payment <br />and accompanying documentation -- all as required by the Contract Documents, <br />Engineer is satisfied that the Work has been completed and Contractor has ful- <br />3� <br />3595a <br />4/81 <br />
