Request for Council Action continued <br />page 2 of 2 <br />June 5, 1995 <br />Zoning File #2015 <br />In the review of the conditional use permit for the guest apartment, members considered the <br />issue of internal access to the apartment area at the third floor. There are three accesses to the <br />apartment area, one via the patio doors at the lower level (via basement, review Exhibits E-2 <br />and F-1). The second access was via the side garage door to a hallway that would lead to the <br />staircase to the upper level (review Exhibits 4 and F-2). Internal access is provided by the link <br />to the addition that consists of a mud room and expansion of the kitchen (review Exhibits E-4, <br />E-5, F-2 and G). Members concurred that at the time of the future addition of the remainder <br />of the principal structure that the current link would be removed. Based on the alignment of the <br />addition and the existing structure, it is impossible to provide internal access in any other way <br />but through the link as proposed. <br />Planning Commission Recommendation <br />The Planning Commission recommended unanimous approval of the application as proposed <br />subject to the conditions set forth in the staff memo of May 4, 1995 and two conditions set forth <br />by Planning Commission at their meeting as follows: <br />5. Applicant to obtain a demolition permit for the removal of the accessory <br />structure, garage. <br />6. Applicant to provide a date at which time applicant proposes the removal of the <br />detached garage and the closing off of the existing drive. Review Exhibit L, <br />applicant's second addendum notes that both garage and drive will be removed <br />by January 1, 1996. Applicant wants to maintain the existing access and garage <br />during the period of construction. Applicant's property is not subject to <br />hardcover controls so applicant's retention of the concrete pad for a limited period <br />of time is of no issue for the City. <br />The enclosed approval resolution has been drafted per the findings and conditions of the <br />Planning Commission's recommendation. <br />COUNCIL ACTION REQUESTED: <br />To either adopt or amend the enclosed approval resolution. <br />ch
