O �. � C ITY of ORONO ,� ..;... � �'� ��r G'�'F RESOLUTION OF THE CITY COUNCIL L`�kEsKO�'`� � No. 4 f� � � A RESOLUTION VACATING A PORTION OF AN UNIMPROVED STREET WITHIN THE PLAT OF BERGQUIST &WICKLUND'S PARK, HENNEPIN COUNTY,MINNESOTA FILE NO. 02-2846 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS,on November 5,2002, Loren Pellett(hereinafter"the applicant")filed a petition with the City of Orono requesting the vacation of a portion of an unimproved public right-of- way originally dedicated in the plat of Bergquist&Wicklund's Park,Hennepin County,Minnesota lying between Lot 3 Block 6 and Lot 5 Block 6 thereof, and legally described as follows: That part of Lake Street as dedicated in Bergquist & Wicklund's Park, which lies . between the southerly extension of the east and west lines of Lot 4,Block 6 in said Bergquist &Wicklund's Park,Hennepin County,Minnesota; and WHEREAS,after due published and posted notice,a public hearing was held by the City's Planning Commission on November 18, 2002 regarding said vacation and all interested persons were given an opportunity to be heard; and WHEREAS, after due standing and consideration, the Planning Commission recommended unanimous approval of the proposed vacation; and WHEREAS, the City Council of the City of Orono finds that said vacation as proposed is in keeping with the public interest and hereby makes the followin;findings; 1. The unimproved right-of-way contains no municipal sewer or other utilities. � 2. The 50 foot right-of-way has never been developed as a public street. 3. The unimproved 50 foot right of way has been found to serve no future public purpose. 4. The vacation does not affect access to or use of any adjoining property. � Page 1 of 2 �
