Structures and accessory facilities, except stairways, landings and lock boxes, must not be pl ace d within bluff impact zones . <br />(4) Uses without wocer-oriented needs. Uses without water-oriented needs m u st be l ocated on lots or parcels with out public waters frontage, or, if located on lots or <br />parcels with public waters frontage, must either be set back double the normal ordinary high water level setback or be substantially scr eened from vi ew from the <br />water by vegetation or topography, assuming summer, leaf-o n conditions. <br />(S) Fences, docks, re taining walls. No fence shall b e placed w ithin the shore se tback zone. Portions of dock located landward of the OHW L shall be considered as a <br />landing, subject to the r egu lations for landings per section 78-1282. Retaining walls shall not be placed w ithin the shore setback zone. <br />(6) Average lakeshore secback. No principal or accessory structure shall be located closer to the lakeshore than the average distance from the shoreline of existi ng <br />r esidence buildings on adjace nt l ots; except that this does not apply t o stairways, lifts, landings, lockboxes, flagpoles and pump houses. Further, the average <br />lakesh ore setback shall apply only to classified lakes and shall not apply t o tributaries. The average lakeshore setbac k line shall be a straight line connecting the <br />most lakeward protrusions of the r esidence buildings on the Immed iately adjacent lake shore lots. <br />a. In instances where the average lakeshore se tback can n ot be met, administrative approval may be granted at the discretion of t he planning director provided <br />no la ke views of an adjacent lakeshore lot are obstr u cted and adjacent neighbors provide written approval. <br />(Ord. No. 106 3rd se r ies,§ 28, 6-10-20 13) <br />Sec. 78-1 680. -Ha rdcover restriction zones. <br />Within 75 feet of the ordinary high water level (OHWL) o f any lake or trib utary, and within any bluff or shore impact zone, no hardcover sha ll be placed, l ocated or <br />constructed, except for driveways, stairways, lifts, landings and lockboxes as regulated by the shoreland overlay district. <br />(Ord. No. 94 3rd serie s,§ 11 , 9-24-2012) <br />Sec. 78-1700. -Speci fic tier regulations. <br />Per the officia l stormwater quality overlay district map, each property in the stormwater quality pr otection overlay district is assigned to a prot ection t ier based on i ts <br />re lative distance to receiving waters. Thi s protection t ier dictates t he specific protect ion m easures t hat must be implemented. <br />(1) Tier 1 parcels. Hardcover shall not exceed 25 percent of the gross lot area. <br />(2) Tier 2 parcels. Hardcover sh all not exceed 30 percent of the gross lot area. <br />(3) Tier 3 parcels. Hardcover shall not exceed 35 percent of the gross lot area. <br />(4) Tier 4 parcels. Hardcover shall not exceed 50 p erce nt of the gross lot area. <br />(5) Tier 5 parcels.
