r City of ORONO RESOLUTION OF THE CITY COUNCIL NO. 2812 CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the findings noted above, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.22, Subdivision 2 to allow 50.4% hardcover in the 75-250' setback zone where only 25% hardcover is normally allowed, and grants variances to Section 10.23, Subdivision 6 (B) to allow construction of the proposed attached garage located 9. 3' from the south side 1 ine, 2 4' from the north side lot 1 ine, and 6.7' from the street lot line, subject to the following conditions: 1. Hardcover on the property sha 11 be 1 imi ted to 2,230 square feet or 50.4%, in the areas shown on the attached survey (Exhibit A). The applicant is advised that any future proposal to increase hardcover on the property will not be approved, but might be approved only in conjunction with concurrent removals of existing hardcover, resulting in no net hardcover increase. 2. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (May 29, 1991). 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted he~ein, and shall be punishable as a misdemeanor. 4. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, ~is heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
