;. , 1tv of O ONO <br />r' RESOLUTION OF THE CITY COUNCIL <br />UThe <br />NO. 1837 <br />City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning distrirect; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would no; merely serve as a <br />convenience to the applicant, but is :,ecessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to pre- <br />serve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehenoive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council <br />hereby grants a variance to the Municipal Zoning Code Section <br />10.22, bdivision 2 to permit the construction of a patio to be <br />located artically within the 0-75 foot lakeshore setback zone <br />where no structures or hardcover are normally allowed subject to <br />the following conditions: <br />1. Per the directive of Resolution 1768, adopted by the <br />Council on May 28, 1985, the existing concrete patio in the <br />0-75' lakeshore setback zone, and ti s existing concrete <br />sidewalk between said patio and the lake, shal' be removed <br />by September 30, 1985. <br />2. A new patio of dimensions 121x18' which encroaches 5' <br />into the 0-75' lakeshore setback zone, is hereby allowed to <br />be constructed, incorporating the existing portion of <br />sidewalk between the house and the existing patio. <br />3. Rased on the above conditions, the following hardcover <br />areas are approved for this property: <br />(0-75' Lot Area - 6,550 s.f.)
