Rezoning of the Property and the Adjacent Parcel from RR-1B Single Family Rural <br /> Residential District to B-6 Highway Commercial District Planned Unit Development <br /> �(B-6 PUD); and, . <br /> 2. Commercial site plan approval and conditions for proposed office building on the <br /> Property and the Adj acent Parcel,• and � <br /> WHEREAS,the Applicants have agreed to execute Planned Unit Development No. <br /> 3 Agreement providing for the installation of certain improvements as a condition of site plan <br /> approval for the construction of a Medical Office Building on the Property and on a portion of the <br /> Adjacent Parcel, and which agreement documents the general and detailed conditions for use and <br /> development of the Property and the Adj acent Paxcel; and <br /> WHEREAS, the Applicants have agreed to submit and execute a Shared Access and <br /> . Parking Agreement over the portions of driveways and parking areas within the Adj acent Parcel that <br /> � will be used to meet the parking requirements for the building to be developed on the Property;and <br /> WHEREAS,the Applicants have agreed to grant public easements to the City over <br /> existing and proposed trails and sidewalks within the Property and the Adjacent Parcel. However, <br /> it is specifically noted that it is the City's goal to locate the proposed trail along Highway 12 within <br /> the Highway 12 right-of-way, and will only make use of the easement along Highway 12 if <br /> placement of trail in the right-of-way is not possible; and � <br /> WHEREAS, the Developer has completed or has agreed to complete all other <br /> requirements of the Zoning Code and related Ordinances of the City including: <br /> 1. Submittal of Minnehaha Creek Watershed District (MCWD)permit approving the <br /> grading and stormwater management facilities plan for the development of the <br /> Property and the Adjacent Parcel as proposed per the Grading, Drainage and <br /> Erosion Control Plan, Sheet C3.1 dated 9-18-02. <br /> 2. Payment to the City of Stormwater and Drainage Trunk Fees for the development <br /> of the Property in the amount of$12,986.00 based on Trunk Fee of$6,480 per acre <br /> and gross acreage of Property at 87,279 s.f. or 2.004 acres including those portions � <br /> subject to trail and sidewalk easements <br /> � <br /> Page 2 of 7 <br />
