NO. � � � � RESOLUTION APPROVING THE FLEMING TRAIL ADDITION FINAL PLAT AND FINAL DEVELOPMENT PLANS WHEREAS,the City of Long Lake owns certain real property located in the City of Long Lake which includes Lots 1 through 13,Block 1; Outlots A, B, C,D, and E of the Fleming Trail Addition,Hennepin County,Minnesota("the Property"); and • WHEREAS,the City of Orono recorded a Declaration of Covenants against the Property dated May 24, 1993, filed August 18, 1993 as Document No. 6135631; and WHEREAS,the City of Orono recorded an amended Declaration of Covenants dated May 15, 2001,which shall be recorded as part of the closing of this transaction; and WHEREAS, the City of Long Lake entered into a Purchase Agreement with Lundgren Bros. Construction, Inc. for the sale and development of 13 single-family homes consistent with � the recorded covenants on Lots 1 through 13, Block 1; Outlots A, B, C, D, and E of the Fleming Trail Addition; and WHEREAS,prior to selling the properly to Lundgren Bros. Construction, Inc., the City of Orono needs to approve the final plat and development plans for the Fleming Trail Addition; and � WHEREAS, on October 15, 2002,the City of Long Lake adopted a resolution approving the final plat and development plans for the Fleming Trail Addition. NOW THEREFORE BE IT RESOLVED,by the City Council of the City of Orono that 1. The final plat and final development plans for Fleming Trail Addition are . substantially similar to the approved preliminary plat,preliminary development plans, and the existing covenants that run with the land within this subdivision; and 2. The final plat and final development plans for Fleming Trail Addition are consistent with the Declaration of Covenants recorded against the property; and 3. The City is not opposed to the concept of modifying the grading plan on and adjacent � to Lot 1,Block 1 to permit the inclusion of an earth berm approximately five feet in height to replace the planned retaining wall and to provide for enhanced screening � between the Fleming Trail Addition and the residential parcels on Orono Oaks Drive.
