NO. � � � � <br /> RESOLUTION APPROVING THE <br /> FLEMING TRAIL ADDITION FINAL PLAT AND FINAL DEVELOPMENT PLANS <br /> WHEREAS,the City of Long Lake owns certain real property located in the City of Long <br /> Lake which includes Lots 1 through 13,Block 1; Outlots A, B, C,D, and E of the Fleming Trail <br /> Addition,Hennepin County,Minnesota("the Property"); and • <br /> WHEREAS,the City of Orono recorded a Declaration of Covenants against the Property <br /> dated May 24, 1993, filed August 18, 1993 as Document No. 6135631; and <br /> WHEREAS,the City of Orono recorded an amended Declaration of Covenants dated <br /> May 15, 2001,which shall be recorded as part of the closing of this transaction; and <br /> WHEREAS, the City of Long Lake entered into a Purchase Agreement with Lundgren <br /> Bros. Construction, Inc. for the sale and development of 13 single-family homes consistent with <br /> � the recorded covenants on Lots 1 through 13, Block 1; Outlots A, B, C, D, and E of the Fleming <br /> Trail Addition; and <br /> WHEREAS,prior to selling the properly to Lundgren Bros. Construction, Inc., the City <br /> of Orono needs to approve the final plat and development plans for the Fleming Trail Addition; <br /> and � <br /> WHEREAS, on October 15, 2002,the City of Long Lake adopted a resolution approving <br /> the final plat and development plans for the Fleming Trail Addition. <br /> NOW THEREFORE BE IT RESOLVED,by the City Council of the City of Orono that <br /> 1. The final plat and final development plans for Fleming Trail Addition are <br /> . substantially similar to the approved preliminary plat,preliminary development plans, <br /> and the existing covenants that run with the land within this subdivision; and <br /> 2. The final plat and final development plans for Fleming Trail Addition are consistent <br /> with the Declaration of Covenants recorded against the property; and <br /> 3. The City is not opposed to the concept of modifying the grading plan on and adjacent � <br /> to Lot 1,Block 1 to permit the inclusion of an earth berm approximately five feet in <br /> height to replace the planned retaining wall and to provide for enhanced screening <br /> � between the Fleming Trail Addition and the residential parcels on Orono Oaks Drive. <br />
