NO. � � � t�i <br /> B. The topography of the property is such that runoff will drain toward the <br /> lake and not toward neighboring properties. All the property within 75' of <br /> the lakeshore will provide an adequate absorption area. <br /> I C. The adjacent properties are not affected bythe garage and foyer addition. <br /> ! <br /> � D. A portion of the garage addition is over existing driveway hardcover. <br /> - E. The lot coverage by structures is well below the allowed 15%. <br /> F. The property has water on two sides,with almost 80%of the property within <br /> � 75' of the lakeshore. <br /> � ' � <br /> 4. The City Council finds that the conditions existing on this property are peculiar to it <br /> � and do not apply generally to other property in this zoning district; that granting the <br /> ^ variance will not adversely affect traffic conditions,light, air,nor pose a fire hazard � <br /> �J or other danger to neighboring property;would not merely serve as a convenience to <br /> the applicants,but is necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the applicants; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> � <br /> City. <br /> I <br /> � 5. The City Council has considered this application including the findings and <br /> 1 recommendations of the Planning Commission,reports by City Staff, comments <br /> by the applicants and the effect of the proposed variances on the health, safety and - <br /> welfare of the community. <br /> CONCLUSIONS,ORDER,AND CONDITIONS . <br /> Based upon one or more of the above findings,the Orono City Council hereby grants <br /> a variance to Municipal Zoning Code Section 10.22,Subdivision 2 and Section 10.56, Subdivision <br /> , 16(L)(2)to permit 4,965.4s.f.(33.0%)hardcover in the 75-250'lakeshore setback where 4,965.4 s.f. <br /> � (30.8%) hardcover exists and 3,706.5 s.f. (25%) is allowed to permit construction of an attached <br /> garage and foyer to the existing residence. Approval is subject to the following conditions: <br /> � <br /> 1. Council approval is based on the site plan submitted by the applicants attached to this <br /> resolution as Exhibit B.
