CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3000 <br />6. City staff has verified that a previously existing tile <br />line used for direct laundry waste discharge to the creek by <br />a previous occupant of the property has been eliminated. <br />The construction of the proposed garage will not affect the <br />existing septic system nor will it affect any possible <br />useable future septic system development on the property, <br />because there are no conforming alternative drainfield sites <br />on the property. <br />7. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring properties; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />8. The City Council finds that granting a conditional use <br />permit to allow the construction of a 241x26' detached <br />garage within the floodfringe sheet flow area will not be <br />detrimental to the health, safety or general welfare of the <br />public, would not adversely affect light, air nor pose a <br />fire hazard or other danger to neighboring properties, nor <br />will it depreciate surrounding property values and that the <br />proposed level of use of the property will be in keeping <br />with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono <br />City Council hereby grants a variance to Municipal Zoning Code <br />Sections 10.23, Subdivisions 6 (B) to allow a detached 241x26' <br />garage to be constructed 39' from the front lot line and 37' from <br />the side street lot line where 50' setbacks from those lines are <br />normally required, and grants a variance to allow hardcover in <br />the 75-250' zone of 28.9% where only 25% hardcover is normally <br />allowed, and grants a conditional use permit and variance per <br />Section 10.55, Subdivisions 8 and 10 to allow construction of <br />said detached garage within a floodfringe sheet flow area, <br />subject to the following conditions: <br />Page 3 of 7 <br />
