.Y '."r <br /> • � <br /> � <br /> . - O� <br /> � �/ <br /> � O <br /> O 1 � <br /> a � CITY of ORONO <br /> ,� , : , .;.. � <br /> , ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`�kEsKo4`�G No. � � 5 �' <br /> A RESOLUTION GRANTING A CONDITIONAL USE <br /> PERMIT PER SECTION 10.03, SUBDIVISION 19 <br /> FILE NO. 02-2819 <br /> WHEREAS,Timothy Devries and Gayle Devries,(hereinafter"the applicants")are <br /> owners of the property located at 2180 Abingdon Way within the City of Orono (hereinafter "the <br /> City") and legally described as follows: , <br /> Lot 6, Block l, Abingdon Glen, Hennepin County, Minnesota (hereinafter "the <br /> property"); and <br /> WHEREAS,the applicants have applied for a conditional use permit per Municipal <br /> Zoning Code Section 10.03,Subdivision 19 to permit land alteration of 1,040 cubic yards of fill to be <br /> moved, approximately 120 cubic yards of which will be trucked from the property to another <br /> . location, approximately 500 cubic yards will be trucked to the property located at 2150 Abingdon <br /> . Way,and the remaining 420 cubic yards will be used as a base fill for construction of a tennis court; � <br /> and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on August 19,2002,at which time all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> � FINDINGS <br /> 1. This application was reviewed as Zoning File#02-2819. <br /> 2. The property is located in the RR-1B, Single Family Rural Residential Zoning <br /> District. <br /> 3. The Orono Planning Commission reviewed this application on August 19,2002 and <br /> recommended approval by a vote of 5 to 0.� <br /> � � 4.
