3. No activities shall be permitted on the mounds of the <br />Greywater Mound Systems that might damage the systems. Prohibited <br />activities include, but are not limited to the following: <br />a) Vehicular traffic. <br />b) Digging or excavating except in connection <br />with construction, maintenance and repair. <br />c) Gardening. <br />d) Construction and maintenance of improvements <br />or buildings of any kind. <br />e) Parking. <br />4. The owners may use Outlot B for and other purposes <br />not prohibited by or inconsistent with this Declaration or local, <br />county, State or Federal law. <br />5. No improvements may be constructed or made on Outlot <br />B without the consent of all of the owners. The costs of construction, <br />maintenance and repair of any improvement will be paid 1/3 by the owners <br />of each of the benefited lots. <br />6. Each owner's share of such costs shall be due and <br />payable on the date such posts for construction, maintenance or repair <br />are due and payable to the person or entity rendering an account <br />therefore. Each owner's share of such costs shall bear interest at a <br />rate of eight (8) percent per annum from such due date to the date of <br />payment. Any owner may bring action, on behalf of the non -defaulting <br />Owners, to collect a iefaulting Owner's share of such costs which are <br />not paid when due, and shall be entitled to recover such reasonable <br />attorney's fees as the court may allow, together with all necessary <br />costs and disbursements incurred in connection therewith. <br />7. No Owner may exempt himself from the liability for <br />assessments by waiver of the use or enjoyment of Outlot B or by the <br />abandonment of his Lot. <br />8. In the event tha; the Owners of each Lot described <br />herein fail to maintain, repair o- replace the Greywater Mound Systems <br />as provided for herein, it is agreed by all parties that the City <br />of Orono may undertake to maintain, repair and replace the Greywater <br />Mound System as provided for herein, and that such actions by the City <br />of Orono will not result in the Greywater Mound System's becoming a <br />public easement, and that each of the Owners will pay to the City of <br />Orono the proportionate cost incurred by the City of Orono within <br />thirty (30) days of the receipt of such charges, or else such charge <br />shall become a lien upon each Lot at the proportion as provided for <br />
