To: Mayor Grabek
Orono Council Members
City Administrator Bernhardson
From: Michael P. Gaffron, Asst Planning & Zoning Administrator
Date: March 6, 1989
Subject: #1371 Pcbert & Teresa Minkema, 3200 Bayside Road -
Variance - Resolution
Zoning District - LR-lA, single family, 2 acre, unsewered
Application - Request for front and side street setback variances to
construct additions to existing residence btructure.
List of Exhibits
Exhibit A - Planning Commission Action Notice of 2/24/89
Exhibit B - Planning Commission Minutes of 2/21/89
Exhibit C - Proposed Resolution
Exhibit D - Memo & Exhibits if 2/13/89
Discussion -
Please review the memo ana exhibits of February 13, 1989. The
applicant is proposing to construct additions to his existing house, which
is located near the front lot line (Bayside Road) and side street lot line
;Leaf Street) than the required setbacks. Applicant is proposing to
construct an addition to the north end of the house, continuing the east
line of the existing house, so there will be no further encroachment past
the existing 33.8' side street setback. In the front, the additionS will
encroach no closer than the existing house.
Planning C-vmaission Recosimendation
At their February 21, 1989 meeting, Plannirq Commission voted 6 to 0
to recummend approval c,f the setback variances for the pruposed additions,
teased on the following findings:
1. The existing residence is 1(,cated entirely within the required
front and side street setbacks, and therefore any additions to the
e.cist-ng residence require a variance.
2. The plight of the landowner is due to circumstances unique to his
property not crFated by the landowner.
3. Granting of the variance will nut alter the essential character
of the locality.
4. The special conditions applying to this structure are peculiar to
this property.
5. The existing residence is unusually close to the front and side
street tot lines, which is unusual for properties in the LP-lA zoning
district genetally.
