A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />FILE #1346 <br />WHEREAS, Einar Hagberg (hereinafter "the applicant") is the owner <br />of the property located at 740 North Arm Drive within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Lot 4, Auditor's Subdivision No. 362, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.22, Subdivision 2 to permit the <br />construction of a detached storage garage which will increase the hardcover <br />in the 75-250' lakeshore setback zone in excess of the 25% hardcover <br />normally allowed in that zone. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1346. <br />2. ;he property is located in the LR-lB Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on October <br />17, 1988 and November 21, 1988 and recommended approval of the <br />proposed variance based upon the following findings: <br />A) A significant percentage of the existing hardcover in the 0- <br />75' zone and a small percentage of the hardcover in the 75-250' <br />zone is due to an existing gravel driveway providing access from <br />the higher rear of the property to the lower lakeshore, and from <br />which the City derives some benefit by its existence due to the <br />ability of the City to use that driveway for maintaining the <br />existing sewer line, hence the area of that gravel driveway <br />should be excluded from both numerator and dencminator of the <br />hardcover calculation, thereby reducing the hardcover percentages <br />on the property. <br />Page 1 of 5 <br />
