City ®f OR ONO <br />RESOLUTION OF THE CITY COUNCIL <br />... 1844 <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council hereby grants a Conditional Use Permit to Municipal Zoning <br />Code Section 10.03, Subdivision 19 to permit the installation of a <br />decorative pond, subject to the following conditions: <br />1. Prior to the issuance of a land alteration permit by the City <br />to permit the installation of the c.ond, the City must approve <br />final grading and landscape plans for banks and edge of pond, <br />temporary channel to southern culvert and upland slopes within <br />watershed. <br />2. City will not allow construction of channel to north until <br />final plans for wildlife pond alteration are approved. <br />3. The City will not approve the use of chemical agents in the <br />control of algae and aquatic vegetation within the decorative <br />pond. The City will not permit the use of fertilizers, <br />pesticides or herbicides within 30 feet from the edge of the <br />decorative pond. <br />4. Violation of or non-compliance with any of the terms and <br />conditions of this permit shall constitute a violation of the <br />zoning code, shall automatically terminate any authority granted <br />herein, and shall be punishable as a misdemeanor. <br />5. The undersigned owners have read, understood and hereby <br />agree to the terms of this resolution and on behalf of them- <br />selves, their heirs, successors and assigns, hereby agrees to the <br />recording of this resolution in the chain of title of the <br />property. <br />Adopted by the Orono City Council on this 9th day of <br />Septpmber, 1985. <br />ATTHST: <br />D6rothy M allin, City Clerk Ma C.
