The <br />applicants are requesting vacation of a portion of. a Conservation and <br />Flowage Easement that is no longer necessary due to grading changes on the <br />property. The drainage easement in question was originally created in <br />1982, prior to the re -grading of the pond. In 1985, conditional use <br />permits were granted that allowed the pond to be re -built. The pond was <br />subsequently re -graded, however the easement was never changed to reflect <br />the new boundaries of the pond. <br />The current application makes that revision, and was initiated due to <br />the location of a new tennis court being more than 26' from the actual <br />wetland, but less than 26' from the edge of the historic easement. <br />Staff Recommendation - <br />Staff recommends approval of a vacation of a portion of Conservation <br />and Flowage Easements (drainage easement) per the attached resolution. <br />av <br />
