� �� <br /> i O r� � � <br /> � ' � CITY of ORONO <br /> 3 <br /> � . .;f ,ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ���kES�I���� NO. � � o� � <br /> A RESOLUTION GRANTING VARIANCE <br /> TO MLTNICIPAL ZO1vING CODE <br /> SECTION 10.24, SUBDIVISION 5(B), . <br /> SECTION 10.22, SUBDIVISION 2 AND ' <br /> � SECTION 10.56, SUBDIVISION 16(L)(2), <br /> FILE NO. 02-2798 <br /> WHEREAS, Fred Shearer and Karen Shearer, husband and wife, (hereinafter "the <br /> applicants") are the owners of the property located at 1405 Park Drive within the City of Orono <br /> (hereinafter "the City") and legally described as follows: <br /> Lots 1, Block 15, Saga Hill Revised, including the adjacent part of vacated streets, <br /> Hennepin County, Minnesota (hereinafter "the property"); and <br /> , <br /> WHEREAS, the applicants have applied to the City for a variance to Municipal <br /> � Zoning Code Section 10.24, Subdivision 5 (B), Section 10.22, Subdivision 2 and Section 10.56, <br /> Subdivision 16 (L)(2) to permit construction of a third stall garage to the existing residence to be <br /> located 9.8' from the side property line where 10' is required, 27.9' from the front property line <br /> where 30' is required in the LR-1B zoning district and to permit 4,376 s.f.(28.9%)hardcover in the <br /> 75-250' lakeshore setback where 4,363 s.f. (28.8%) hardcover exists and 3,779.75 s.f. (25%) is <br /> allowed; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on July 15, 2002, at which time all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: • <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#02-2798. <br /> 2. The property is located in the LR-1B Zoning District. where 1 acre is the minimum � <br /> required lot area.
