( <br />( <br />DATE: 02/04 <br />SECTION: 4110 <br />PAGE: 4 <br />Limiutioni <br />A local board of ^rpeal and equalizatiun may reduce assessments upon pet ' Jon of tlie <br />taxpayer but the total adjustments must not reduce the aggregate assessment made by the <br />county assessor by more than one percent If the total adjustments would lower the aggregate <br />assessments made by the county assessor by more than one percent none of the adjustments <br />may be made. The assessor shall correct any clerical errors or double assessments discovered <br />by the board of appeal and equalization without affecting the one percent referred to above. <br />A local board of appeal and equalization does not have the authority to grant an exemption or <br />to order property removed from the tax rolls. (M.S. 274.01) <br />Summary <br />•M.S. 274.01 provides that dre town board of each township and the governing bod>' of cities <br />shall be tire local board of ^rpeal and equalization. The board is to review the asses.sment and <br />classification of property in their township or city. <br />The county assessor sets the dates for boards of appeal and equalization to meet in his county. <br />He must notify the cleric of the various dates on or before February 15 of each year. The <br />meetings art held between April 1 and May 31 . <br />Duties of Local Boards of Appeal and Equalization <br />1 . See that all taxable property’ in the township is properly as.sessed. valued and <br />classified. The board may consider both real and personal property'. <br />2. If any property has been omined. the board must correct the assessment by adding it to <br />the list of assessments along with its market value. <br />3. The assessments of each descripbon of real property’ consisting of land and buildings <br />are reviewed by the b <br />4. The assessments of persona] property are likewise u ithin the board’s jurisdiction. <br />Persona] property is limited to mobile homes, storage sheds, decks or similar <br />improvements located in a manufactured home p>ark, structures on lea5;ed public lands <br />and railroad operating rights-of-wa}’ and leased buildings located on land ouncd by <br />the occvpmx and used for purposes of a homestead. <br />5. The authorit)’ of die local board extends over the indi\idua] assessments of real and <br />personal properly. The board can*t increase or decrease by jxrccntage all of the <br />assessments in the district of a given class of prjpcrty. Changes in the aggregate <br />assessments by classes are made by the counU* board of appeal and equalizanon.
