The definition of the term "Owner," in Paragraph 1 of <br />the Road Declaration, is hereby amended to read as follows: <br />3. <br />"Owner" shall mean and refer to the record <br />owner, whether one or more persons or <br />entities, of the fee simple title to any Lot; <br />provided, however, that if any Lot is being <br />sold on a contract for deed pursuant to which <br />the purchaser is entitled to possession of the <br />Lot, the contract for deed purchaser, whether <br />one or more persons or entities, shall be <br />considered the "Owner" of the Lot so long as <br />such contract for deed shall remain in effect, <br />provided the Association shall have received a <br />complete and true copy of such contract for <br />deed. <br />The definition of the term "Maintenance," in <br />Paragraph 1 of the Road Declaration, is hereby amended to read <br />as follows: <br />"Maintenance" shall mean and refer to <br />snowplowing, salting and sanding, sweeping, <br />sealcoating, asphalt patching, asphalt <br />replacement, shoulder grading, shoulder <br />weed control, and such additional ordinary <br />and necessary maintenance as the Owners of <br />a majority of the Lots shall deem <br />appropriate from time to time for the <br />purpose of providing a good, safe, freely <br />travelable and well-maintained road on the <br />Roadway. <br />4. Paragraph 1 of the Road Declaration is hereby amended <br />by deleting the definition of the term "Properties". <br />-4-
