376Z034 <br />Hennepin County, Minnesota; has acquired or is in the process <br />of acquiring from the owner of Lot 1, Block 2, and Outlot C, <br />Bayside Landing, an easement for driveway purposes over said <br />Lot 1, Block 2, for the benefit of Lot 1, Block 1, Burger's <br />Bayside Second Addition; and wishes to obtain the benefits of <br />the Declaration for, and subject to' the burdens of the <br />Declaration, said Lot 1, Block 1, Burger's Bayside Second <br />Addition. <br />F. In order to · aid in administering the terms of the <br />Declaration and a related declaration relating to the private <br />road on Outlot D, Bayside Landing, the owners of the lots <br />subject to the Declaration have caused to be formed a Minnesota <br />non-profit corporation known as Landmark Drive Homeowners <br />Association. <br />G. The undersigned owners of the real property described <br />on the signature pages attached to this Agreement wish to amend <br />the Declaration and to set forth in writing the terms of their <br />agreement with respect to the foregoing. <br />NOW, THEREFORE, in consideration of the facts stated above <br />and for other good and valuable consideration, the receipt and <br />sufficiency of which are hereby acknowledged by each of the <br />undersigned, the undersigned hereby agree as follows. <br />L The Declaration is hereby amended to substitute the <br />term "Lot" in lieu of the term "lot," and the term <br />"Associati0n" in lieu of the term "Landmark Construction, <br />Inc.," throughout the Declaration. <br />2. Paragraph 1 of the Declaration is hereby amended to <br />read as follows: <br />1. Land Use and Bui ldinq Type. Each <br />of the Lots shall be used and occupied solely <br />as private, detached, one-family residences. <br />Each dwelling built or to be built upon any <br />Lot shall be built with a garage designed to <br />accommodate a minimum of two (2) automobiles. <br />Plans for all present or future construction <br />or remodeling of or additions to such <br />dwellings shall be submitted for approval as <br />provided in paragraph 2 below. <br />3. Paragraphs 4 and 5 of the Declaration shall apply <br />only to the Lots, and not to any of the Outlots. <br />4. Paragraph 7 of the Declaration is hereby amended to <br />read as follows: <br />7.
