AMENDMENT <br />TO <br />DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS <br />This Amendment To Declaration Of Covenants, Conditions And <br />Restrictions amends that certain Declaration Of Covenants, <br />Conditions And Restrictions dated the 9th day of May, 1988, and <br />recorded the 17th day of August, 1988, with the Hennepin County <br />Recorder as Document No. 5444195, and recorded the day of <br />________ , 19_, with the Hennepin County Registrar of Titles, <br />as Document No. Said Declaration involves property <br />located in Hennepin County, Minnesota, legally described as <br />follows: <br />Lot 1, Block 1; Lots 1 and 2, Block 2; and <br />Outlets A, B, C and D, Bayside Landing. <br />The undersigned individuals and companies who collectively <br />constitute all of the owners and encumbrancers of the land which <br />is subject to the restrictions against Outlot C, Bayside Landing, <br />contained in said Declaration, or are benefitted by said <br />restrictions, hereby agree to amend said Declaration Of Covenants, <br />Conditions And Restrictions as follows: <br />Paragraph 9(c.) is hereby deleted and in its place is <br />substituted the following paragraph: <br />Outlot C shall be used for driveway ingress, egress, <br />drainage, utility and landscaping purposes for the <br />benefit of Lot 1, Block 2, as well as for the benefit of <br />Lot 1, Block 1, Burger's Bayside Second Addition, and for <br />permitted subdivisions thereof, and for no other purpose <br />and ownership of said Outlot C may not be separated from <br />ownership of said Lot 1, Block 2, Bayside Landing, except <br />for an easement to be granted in favor of said Lot 1, <br />Block 1, Burger's Bayside Second Addition.
