AMENDMENT <br />TO <br />DECLARATION OF PRIVATE ROAD AND UTILITY EASEMENTS <br />AND <br />COVENANT FOR ROAD MAINTENANCE <br />This Amendment To Declaration Of Private Road And Utility <br />Easements And Covenant For Road Maintenance amends that certain <br />Declaration Of Easements And Covenant dated the 9th day of May, <br />1988, and recorded the 17th day of August, 1988, with the Hennepin <br />County Recorder as Document No. 5444194, and recorded the <br />day of _______ , 19 __ , with the Hennepin County Registrar of <br />Titles as Document No. , which affected that certain -------- <br />property located in Hennepin County, Minneosta, legally described <br />as follows: <br />outlot D, Bayside Landing. <br />The undersigned, who collectively constitute all of the owners <br />and encumbrancers of Outlot D, Bayside Landing, and all of the <br />properties benefitted by said Declaration and Covenant, as <br />described in said Declaration and Covenant, hereby agree to amend <br />said Declaration and Covenant as follows: <br />1. The term "Properties" as defined in paragraph no. 1 of <br />said Declaration and Covenant shall be amended by adding <br />the property described as Lot 1, Block 1, Burger's <br />Bayside Second Addition. <br />2. Paragraph no. 4. shall be deleted and in its place shall <br />be substituted the following: <br />Each of the five lots comprising the <br />Properties shall be charged with the <br />responsibility of paying twenty <br />percent ( 2 0%) of the maintenance cost <br />of the Roadway. <br />3. All other terms and conditions of said Declaration and <br />Covenant shall remain unamended.
