/.
CITY of ORONO
May 1, 1992
Torn Barrett
Popham, Haik & Associates
3300 Piper Jaffray Tower
222 Ninth Street South
Minneapolis, MN 55402
Municipal Offices
Post Office Box 66
CrystalBa~Minnesora553~
RE: Application #1734 -John and Mary Burger
3750 Bayside Road -Preliminary Subdivision Application
Dear Torn:
During the preliminary discussions with the applicant regarding
the proposed two-lot subdivision, the issue of access to the
property was of great concern because of the designated wetland
that divided the southern portion of the property from the newly
created parcel to the north. Staff recommended that rather than
achieving access via a long and lengthy roadway through a
designated wetland that applicant achieve access via the Landmark
Subdivision to the immediate west. We advised applicant of the
ordinance amendment that would allow private roads with
underlying public easements to not only provide access to all
homes within the subdivision but the easement would also allow
adjacent properties to achieve reasonable access via the public
easement.
Please review the enclosed plat map. The applicant would propose
access via Landmark Drive and a private driveway easement through
Outlet C and Lot 1, Block 2, Bayside Landing. Staff has been
advised that the current owner of Lot 1 will grant the
appropriate private access easement. The applicant has asked
that the City Attorney reaffirm in writing that Landmark Drive
can be used as access to proposed Lot 1.
Please contact my office if you need additional information. The
Planning Commission wi 11 review this application at their May
18th meeting. Staff must be in receipt of your opinion no later
than May 13th.
Sincerely,
n:l,L11.,,yJ.,-a. '-/J1 ?J(...t~JC , _\ f~ (,,LL(,~
Jeanne A.
