Zoning File #1734 <br />May 13, 1992 <br />Page 4 <br />proposed Stubbs Bay sewer district and that this site was found to <br />have adequate area for an alternate septic site. <br />Outlots A and B <br />As already noted above, the City shall require a special lot <br />combination for Outlot A with Lot 1 and will also require a special <br />lot combination for Out lot B with Lot 2. Out lot B sha 11 be 1 imi ted to <br />providing riparian access or use for solely Lot 2. Because of the <br />limited land area, the property should be limited to one dock and no <br />permanent or temporary parking of vehicles allowed because of the <br />limited land base. <br />Staff wi 11 a 1 so recommend that the specia 1 lot combination for <br />Outlot A prohibits all residential construction. This is based on the <br />findings that emergency vehicles could not achieve immediate access to <br />the property. <br />Staff Recommendation <br />To approve the preliminary subdivision application of John Burger <br />for the property located at 3750 Bayside Road, finding that all <br />standards of the LR-lA zoning district and on-site septic code have <br />been satisfied and grants a variance to Section 10.27, Subdivision 5 <br />(B) granting a width variance for proposed Lot 1 based on the <br />following findings: <br />1. There is no available dry buildable area adjacent to Lot 1. <br />2. The property was originally platted in the current <br />configuration in 1977 when the RR-lA zoning standards were <br />in effect. <br />3. Applicant has demonstrated that a residence can be installed <br />meeting all other standards of the RR-lA zoning district. <br />4. A variance to Section 10.03, Subdivision 6 (B) that would <br />allow the area credit of Outlet A with 4.26 acre dry <br />buildable parcel divided from proposed Lot 1 by the Luce <br />Line based on the following findings: <br />a) Out lot A is land locked and cannot achieve leg a 1 <br />access. <br />b) Out lot A as an independent unit does not meet the <br />required area standard of RR-lA zone.
