(8%) per annum from such date. Any Owner may bring an <br />action on behalf of the non-defaulting Owner or Owners <br />to collect a defaulting Owner's share of such costs and <br />shall be entitled to recover such reasonable attorney's <br />fees as the court mny allow, together with all necessary <br />costs and disbursements incurred in connection therewith. <br />4. Any judgment entered against a lot Owner pursuant to this <br />Agreement shall be a lien on the lot Owner's land legally <br />described on the attached Deed Of Appurtenant Easement, <br />and the Owners waive their homestead exemption pursuant <br />to Article 1, Section 12, of the Constitution Of The <br />State Of Minnesota, or under Minnesota Statutes Section <br />510.01 et seq. for the sole and exclusive purpose of the <br />above described lien. <br />5. Any judgnent lien entered pursuant to this Maintenance <br />Agreement shall be subordinate to any mortgage recorded <br />prior to the docketing of said judgment. <br />6. No lot Owner may seek to avoid payment for maintenance <br />costs by abandonment or non-use of the driveway. <br />7. It is intended that the easement granted herein shall be <br />for ordinary pedestrian and vehicular ingress and egress <br />purposes and any damage which is done to the driveway <br />result~ng from construction traffic, or other heavy use, <br />or installation or repair of utilities shall be repaired <br />at the expense of the lot Owner by whom the traffic or <br />work was generated. <br />8.
