The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicants and the effect of the after-the-fact variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the findings noted above, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.23, Subdivision 6 (B) to permit the construction of an 18 'x2 2' addition to the north or rear side of the existing residence and per Section 10.22, Subdivision 1 (B) grants a variance to the average lakeshore setback as portions of addition will be located in front of the average lakeshore setback line. Approval is subject to the following conditions: 1. Applicants are placed on notice that if loft area is converted to a legal bedroom, the septic system shall be re- evaluated at the time of such improvement. 2. Authorities granted by this resolution run with tre property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance ~ill expire on that date (April 22, 1992). 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on beha 1 f of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the chJin of title of the property.
