MINUTES OF THE PLANNING COMMISSION MEETING OF APRIL 19, 1982 <br />Page 9 <br />Gary Peterson and erne Earnst were present. Olson noted <br />the certificate e,f mailing and the affidavit of publication <br />Mrs. Keesling of 1384 Baldur Park Road, Ted Boer of 1' ' <br />Baldur Park Road and Jerry of 1376 Baldur Park were p lit <br />from the audience. <br />Olson summarized the Tonka Lake Properties 4 lot proposal. <br />Mrs. Keesling noted for the Planning Commission that in <br />order to get across the peninsula you have to go across <br />her property to get to that property. She noted that <br />the lakeshore had eroded 1' already this year. She doesn't <br />see "', they could proceed with this proposal if she <br />doesn't +ant all those people travelling across her <br />property. Can they legally get to the property? <br />Ted Boer stated that no one had an easement over his <br />property which he outlined in a previous letter to the <br />Mayor. The road has encroached on his property S'. lie <br />stated that 8' of erosion had taken place on the <br />lakeshore banks. He stated that all the City had <br />planned to do was condemenation of his propert-. <br />Olson stated that to stabilize the access the only <br />legal way was for the City to establish and define a <br />permanent right of way just where the road is today. <br />We're not saying we need any more land. We only wan: <br />to „gally establish what is there now. This can 1:e <br />done uy the owner granting a- ;asement, by the developer <br />purchasing an easement which ne would then grant to the <br />City or,if necessary, oy condemnation. But we have to <br />estab;'.=h the right of way once and for all before we can <br />stabi;.:ze the road and thereby prevent further encroachment. <br />Jerry stated that the road was already in need of repairs <br />and also goes directly across lots 17, 18, 19 a 20. <br />'-a. Keesling stated that the road can't handle ; more <br />dwelling units much less 1. <br />P.r stated that there was a terrible traffic and parking <br />probl.m on this road. He stated that the City would not <br />even let him pr.t up a sigr. stating "Private Property' to <br />discourage parking. <br />Olson stated that this a separate issue. He recommended <br />that Mr. Boer contact t:9 police or public works de nartment <br />about parking controls. <br />Mrs. Keesling stated that the road was actually a swamp <br />and she felt that it would not be able to handle any more <br />trafri�. She also informed the Planning Commission that <br />Peterson had just listed tre whole Point for sal.- in the <br />MLS book.
