CONTRACTOR shall be ,olely responsible for the <br />means, methods, techniques, sequences and procedures of <br />.instruction, but CONTRACTOR ,hall not be solely respon- <br />sible for the negligence of others in the design or selection of a <br />specific means, method. technique, sequence or procedure of <br />construction which is indicated in and required by the Con- <br />tract Documents. CONTRACTOR shall be responsible !o see <br />that the finished A ork complies accurately with the Contract <br />Documents. <br />6.Z. CONTRACTOR shall keep on the stork at all times <br />during its progress a competent resident superintendent, who <br />shall not be replaced without written notice to OWNER and <br />ENGINEER except under extraordinary circumstances. The <br />superintendent will be CONTRACTOR's representative at the <br />site and shall have authority to act on behalf of CONTRAC- <br />TOR. All communications given to the superintendent shall <br />be as binding as if given to CONTRACTOR. <br />Labor, .Materials and Equipment: <br />6.). CONTRACTOR shall provide competent, suitably <br />qualified personnel to survey and lay out the Work and per- <br />form construction as required by the Contract Documents <br />CONTRACTOR shall at all times maintain good discipline <br />and order at the site Exceat in connection with the safety or <br />protection of persons or the Work or property at the site or <br />adjacent thereto, and except as otherrw tse indicated in the Sup- <br />plementary Conditions, all Work at the site shall be per- <br />formed luring regular working hours, and CONTRACTOR <br />will not permit overumt work or the performance of Work on <br />Saturday, Sunday or any legal holiday without OWNER' <br />written consent given after prior written nonce to <br />ENGINEER. <br />61 CONTRACTOR shall furnish all materials, eguip- <br />ment, labor, transportation, construction equipment and <br />machinery, tools, appliances, fuel, power, light, heat, tele. <br />phone, water and sanitary facilities and all other faciiinn and <br />ncidentais necessary for the execution. testing, •nttial open <br />anon and completion of the Work <br />6.5. A'i matenais and equipment shall be of good quahty <br />and new, except as otherwise provided in the Contract Docu- <br />ments. If required by ENGINEER, CONTRACTOR shall <br />furnish satisfactory evidence (including reports of required <br />tests) as to the kind and qualuv of materials and equipment <br />6.6. All materials and equipment shall he applied, in- <br />stalled, connected, etected, used, cleaned and conditioned in <br />accordance with the instructions of the applicable manufac- <br />turer, fabricator, supplier or distributor, except as otherwise <br />provided in the Contract Documents <br />Equrvalrnt .Materials and Equipment <br />6 " Whenever materials or equipment are specified or dt- <br />scribed in the Drawings or Specifications by using the name of <br />a proprietary item or the name •if a particular manufacturer. <br />ON <br />fabricator. supplier or distributor, the naming of the item is <br />intended !o establish the type, function and quality required. <br />Unless the name is followed by words indicating that no sub- <br />stitution is permitted. materials or equipment of other manu- <br />facturers, fabricators, suppliers or distributors may be <br />accepted by ENGINEER if sufficient information is submit- <br />ted by CONTRACTOR to allow ENGINEER to determine <br />that the material or equipment proposed is equivalent to that <br />named. The procedure for review by ENGINEER wtil be as <br />set forth in paragraphs 5 I and 6.'.2 below as supplemented <br />in the General Requirements. <br />h " I Requests for review it s:bstitute items of <br />material and equipment will not be accepted by ENGi- <br />NEER fr -m anyone other than CONTRACTOR. if CON- <br />TRACTOR wishes to furnish or use a substitute item of <br />material or equipment CONTRACTOR shall make written <br />application to ENGINEER for acceptance thereof, certify- <br />ing that the proposed substitute will perform adequately <br />the functions called for by the general design, be similar <br />and of equal substance to that spe,::tied and be suited to <br />the same use and capable of performing the same function <br />as that specified. The application will state whether or not <br />acceptance of the substitute for use in the Work will <br />r^quire a change is the Drawings or Specifications to adapt <br />the design to the substitute and whether or not incorpora- <br />tion or use of the substitute in connection with the Work is <br />sub)ect to payment of any license fee or royalty. All <br />variations of the proposed subs:itute from that <pecified <br />shall be identified in the application and available mainte- <br />nance, repair and replacement service will be indicated. <br />The application will also contain an itemized estimate of <br />all costs that will result directly or indirectly from accept- <br />ance of such substitute, including costs of redesign and <br />claims of other contractors affected by the resulting <br />change, all of which shall be considered by ENGINEER in <br />evaluating the proposed substitute. ENGINEER may <br />require CONTRACTOR to furnish at CONTRACTOR's <br />expense additional data about the proposed substitute <br />ENGINEER will be the sole judge of acceptability, and no <br />substitute will be ordered or installed without ENGI- <br />NEER's prior written acceptance. OWNER may require <br />CONTR.. --TOR to furnish at CONTRACTOR's expense <br />a special performance guarantee or 3ther surety with <br />respect to any substitute <br />6 ' =.
