MINUfES OF A PLANNING COMMISSION MEETING HELD ON APRIL 10, 1978 <br />PAGE 3 <br />The Village Planner introduced the subdivision. <br />Mr. Kelly was presert_. The Village Planner <br />stated the size of Parcel A, which is 6 acres, <br />should be addressed as to where it will be <br />redivided and where there will be access. Jim <br />Olson concurred that it would be in the best <br />interests of the applicant and the City of Orono <br />to address the access at this time -regarding <br />private or public. The Village Planner stated <br />the Council is in the process of preparing <br />guidelines for the Planning Commission regarding <br />this issue. <br />The Planning Commission indicated that they did not <br />have any problems with this subdivision plan as <br />submitted. The Commission informed Mr. Kelly that <br />any wetlands would be subtracted from the total <br />dry buildable area and that any roads would also <br />be subtracted. The Village Planner noted the <br />wetlands area had not been located and that a survey <br />would have to be submitted indicating the designated <br />wetlands area. <br />WORK SESSION ITEMS <br />Mr. Wittmer was present. The Zoning Administrator <br />stated this is a variance to add onto the existing <br />home on the lake side. He added that this area is <br />sewered. The Planning Commission indicated that <br />they were not in favor of the deck encroaching within <br />75 ft. lakeshore setback, but that they did not have <br />problems with the small portion of the porch or the <br />existing steps encroaching. <br />Mr. Grimes and Mr. Dahl were present. It was noted <br />this is an existing non -conforming situation that <br />the addition needs no variances, but that the <br />existing house encroaches into the front yard setback. <br />The Village Planner stated that the Ordinance states <br />that if the addition is over 507. of the value of the <br />existing structure it is considered a new structure <br />and requires a variance. <br />Hannah moved, McDonald seconded, a motion that given <br />the fact that this property has been before the <br />Commission and the Council for subdivision and that <br />they are aware of the existing structure and have <br />previously Approved the lot lines, the variance should <br />be approved subject to no new variance being required <br />to add onto the existing structure. <br />Motion: Ayes (6), Nays (0), motion passed. <br />LLOYD KELLY <br />85 South Brown Rd. <br />SUBDIVISION' <br />(#3- 2) <br />WALTER WITTMER <br />1420 Baldur Park Rd. <br />VARIANCE <br />(#368) <br />ORVILLE GRIMES <br />
