DATE: June 15, 1988 <br />TO: Mark Bernhardson, City Administrator �r T <br />FROM: Mel Kilbo, Chief of Police <br />SUBJECT: Jimmies, Inc. <br />On 8/6/87, Jimmies, Inc. was charged under section 4.08 subd. 1 <br />for consuming after pours, subd. 2 for removal of containers <br />from the premises, subd. 3 for being open after normal closing <br />hours. On 8/31/87, it was referred for formal complaint. On <br />10/27/87 he pled not guilty. On 11/24/87 in front of Judge <br />Adzik, Jimmie Holtz pled guilty and was found guilty, fined <br />$300.00 with $225 stayed with a st.-y of 365 days, no same or <br />similar violations. In effect, he paid only a $75 fine. <br />On 1/24/8r, Officer 1'.:r4 Erickson observed, at 1:25 a.m. , a <br />number of people stil' in Jimmies. All the lights were turned <br />on low, the TV's were still on, about 8 to 10 people at the bar <br />still had drinks. The female bartender stated "I've been try- <br />ing to close". The c--:icer questioned the validity of her _- <br />mark in that the lights were still low and the TV's still n. <br />The people did leave because of the officer's arrival. ''".iis is <br />a violation of section 4..; k subd. 3, closina hours. Orono stat- <br />W f-s states that they are to close at 1:00 a.m.. <br />On '24/88, Officer English of our Department made an arrest at <br />Co. Road 15 and Kings Road in Spring Park of a female. She was <br />asked where she was coming from at 12:10 a.m. She stated she <br />had just picked up her friend, Kandis Berg, at Jimmies Bar. The <br />driver was arrested for DWI. Kandis Berg, the passenger and em- <br />ployee of Jimmies, was asked to blow into a portable breath test- <br />ing device to see if she could drive the vehicle. She blew a <br />fail on the device. In checking the right hand passenger side <br />of the v..hicle, a clear glass was found beneath the front edge <br />of the front seat, on the floor, with an odor consistent with <br />that of an alcoholic beverage. The driver indicated that' the <br />glass in the vehicle was the one that kandis Berg had been drink- <br />ing from and she believed that Ms. Berg he-' brought it with her <br />from Jimmies when she picked her up and that she had had no alco- <br />hol in the vehicle before. It is believeu that Kandis Berg. the <br />bartender, removed a container from Jimmies in violation of sec- <br />tion 4.08 subd. 2, removal of a container from the premises. <br />I suggest that this matter be brought to the Council's attention <br />for possible 1 se action against Ji=.,ies . <br />
