(Setback variance if this is considered an accessory <br />structure.) <br />Zoning District - LR-lB fr <br />List of Exhibits <br />Exhibit A - Application <br />Exhibit B - Plat Map f -ems <br />Exhibit C - Property Owners List - <br />Exhibit D - Survey LV 571^^ <br />Exhibit E - Plan & Elevation Views of Proposed Structure <br />Pertinent Code Sections - <br />A) Section 10.03, Subdivision 9 (D) - "No detached garage or other <br />accessory building shall be located nearer the front or street lot <br />line than the principal building on that lot except on lots which have <br />frontage on a lake and a rear yard adjacent to a street, accessory <br />buildings located within the street or rear yards of such lots are <br />sub jec;: to the setback requirements. . .of Section 10.24, Subdivision <br />5 (B). . . except that detached garages may be located 10' from the <br />street or rear lot line if doors face away from the street and a turn- <br />around is provided on the site. This section shall not apply to <br />lakeshore lots divided by roadways or corner lots." <br />B) Section 10.24, Subdivision 5 (B) - Requires a rear yard setback of <br />301. (For the Pence Lane property in question, no accessory buildings <br />other than a garage would be allowed within 30' of the north lot 'line <br />of the property.) <br />C) Section 10.03, Subdivision 14 (C) - The maximum height of a fence - <br />type structure such as that proposed is 3h'. <br />Pertinent Facts - <br />1. The applicants are requesting to construct an entrance gate for <br />security purposes and they feel that the 3h' maximum height is not <br />sufficient to provide the security they require. The entire <br />structure, including the gate, is approximately 40' in width. <br />The proposed gateway is about 4' in height with monument roof peak on <br />each side of about 7h'. <br />
