' <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 10.22, SUBDIVISION 2 AND <br /> SECTION 10.56, SUBDIVISION 16 (L) (2) <br /> FILE NO. #02-2778 <br /> WHEREAS, Kevin Manley and Janet Manley, husband and wife, (hereinafter <br /> "the applicants") are owners of the property located at 1973 Fagerness Point Road within the <br /> City of Orono (hereinafter "the City") and is legally described as follows: <br /> Lot 7, Fagerness, Hennepin County, Minnesota Lr? l S,er iCCS Inc. <br /> (hereinafter "the property"); and ✓ <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on April 15, 2002, at which times all persons desiring to <br /> be heard concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS, the applicants applied to the City of Orono for variances to <br /> Municipal Zoning Code Section 10.22, Subdivision 1 and Section 10.56, Subdivision 16 (C) <br /> (6) to permit an expansion of the roof line and raising the roof within 75' of the lakeshore; and <br /> for variances to Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (2) to <br /> permit additional hardcover within the 75-250' Lakeshore setback over 25% and to Section <br /> 10.03, Subdivision 14 (C) to permit additional structure over 15% on the property; and <br /> WHEREAS, the Council approved variances to permit the expansion of the roof <br /> line and raising the roof of the house on April 22, 2002; and <br /> WHEREAS, the Council tabled the variance request for the deck addition on <br /> April 22, 2002 to allow the property owner to revise the plan to lower the deck below 6' to <br /> eliminate the variance request that increases the lot coverage by structure; and <br /> NOW, THEREFORE,, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota; <br /> 1. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air nor <br /> Page 1 of 4 <br />
