N0. � � � � <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 10.22 SUBDIVISION 1(B) <br /> AND SECTION 10.56 SUBDIVISION 16(C)(� ; <br /> FILE NO. 03-2899 � <br /> WHEREAS, Timothy Pellizer, a single person, (hereinafter "the applicant")is the <br /> owner of the property located at 520 North Arm Drive within the City of Orono (hereinafter the <br /> "City") and legally described as follows: <br /> Lot 3,Block 1,Victoria Estates,Hennepin County,Minnesota <br /> (hereinafter the "property"); and <br /> WI�EREAS,the applicant has made application to the City of Orono for a variance <br /> • to Orono Municipal Zoning Code Sections 10.22,Subdivision 1(B)and 10.56,Subdivision 16(C)(6) <br /> to allow construction of an addition to the existing residence,such addition encroaching as much as <br /> 68'past the defined average lakeshore setback line where no encroachment is normally allowed. <br /> NOW, THEREFORE SE IT� RESOI,VED by the City Council of Orono, <br /> Minnesota: - <br /> � FINDINGS <br /> 1. This application was reviewed as Zoning File#03-2899. <br /> 2. The property is located in the LR-lA Lakeshore Residential Zoning District,which <br /> requires minimum lot area of 2.0 acres and minimum lot width of 200'. The lot � <br /> conforms to width and area requirements. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> June 16,2003 and recommended approval of the average lakeshore setback variance <br /> based on the following findings: <br /> a) No neighboring property's lake views would be negatively impacted by the � <br /> proposed garage addition. <br /> • Page 1 of 5 <br />
