The pool <br /> as proposed is 39'from the side lot line but only 6'from the upper level deck. <br /> There is sufficient room to move the pool either northward or eastward to <br /> meet the 10' separation requirement. <br /> c) The proposed pool will not encroach the wetland easement affecting the � <br /> property. <br /> 4. The City Council has considered this application including the findings and <br /> ' recommendations of the Planning Commission,reports by City staff, comments by <br /> the applicants and the public, and the effect of the proposed conditional use permit <br /> on the health, safety and welfare of the community. <br /> 5. The City Council finds that granting a conditional use permit to allow construction <br /> • of a pool accessory structure on a through.lot will not be detrimental to the health, <br /> safety or general welfare of the public,would not adversely affect light,air nor pose <br /> a fire hazard or other danger to neighboring properties, nor will its use depreciate <br /> surrounding property values and that the proposed level of use of the properly will <br /> be in keeping with the intent and obj ectives of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS � <br /> Based upon one or more of the above findings,the Orono City Council hereby grants <br /> a conditional use permit per Orono Municipal Zoning Code Section 10.03 Subdivision 10 and <br /> . Section 10.56 Subdivision 16(C)(6)to allow construction of a pool which constitutes an accessory � <br /> structure on a through lot, subject to the following conditions: <br /> l. Council approval is based on the site plan submitted by the applicants, attached to this <br /> Resolution as Exhibit A,except that the pool shall be relocated northward/eastwazd to meet <br /> the required 10'separation setback from the pool basin to the adj acent deck/stairway system, <br /> while also avoiding any fill or structural encroachment within the defined wetland easement. <br /> Any amendments to the site plan which are not in conformity with City codes will require � <br /> further Planning Commission and City Council review. <br /> � <br /> Page 2 of 5 <br />
