RESOLUTION OF THE CITY COUNCIL <br /> `9kESII04 NO. � 9 '� � <br /> A RESOLUTION APPROVING <br /> RENEWAL OF A CONDITIONAL USE PERMIT <br /> PER SECTION 10.20, SUBDIVISION 3 <br /> FILE NO. #03-2882 <br /> WHEREAS, the Orono Baseball Association in cooperation with the Orono <br /> Soccer Association (hereinafter "the applicants") are in the process of leasing property from the <br /> Orono School District (hereinafter "the owner") located at 1030 Old Crystal Bay Road North <br /> for the purposes of constructing a third baseball field, with a secondary use as a youth soccer <br /> field within the City of Orono (hereinafter "the City") the property is legally described as ' <br /> follows: <br /> See Exliibit A, (hereinafter "the property"); and <br /> . WHEREAS, after due published notice and mailed notice in accordance with <br /> . Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on April 21, 2003, at which times all persons desiring to <br /> be heard conceming this application were given the opportunity to speak thereon; and <br /> WHEREAS, the applicants have applied for renewal of a conditional use permit <br /> originally granted by the Ciiy Council on September 10, 2001 as documented in Resolution No. <br /> 4689, per Municipal Zoning Code Section 10.20, Subdivision 3 to permit construction of a <br /> combined baseball field and youth soccer field on the northeast corner of the property. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: • <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #03-2882. <br /> 2. The original CUP approval was granted per Resolution No. 4689 adopted <br /> September 10, 2001. <br /> 2. The property is located in the RR-1B rural residential zoning district. <br /> 3.
